About this event
Many arbitration disputes become more complicated than they need to be because of decisions made at the very beginning. The arbitration clause is copied without careful review. The notice is drafted in haste. The response escalates issues that could have been managed more calmly.
Part 1 of the Arbitration Nuts and Bolts Series focuses on this critical entry stage of arbitration from counsel’s perspective.
Using a single working scenario, the faculty will guide participants through:
- identifying defects in arbitration clauses and understanding the risks they create
- approaching commencement strategically when drafting a Notice of Arbitration
- responding in a way that preserves objections without triggering unnecessary procedural battles
This session is practical and document led. We will work through real drafting issues that practitioners face and discuss the judgment calls that shape the direction of proceedings before a tribunal is even constituted.
